{"id":164,"date":"2024-03-05T15:18:49","date_gmt":"2024-03-05T15:18:49","guid":{"rendered":"https:\/\/equalpaynwt.ca\/?page_id=164"},"modified":"2024-04-03T12:47:49","modified_gmt":"2024-04-03T12:47:49","slug":"processus-de-plainte","status":"publish","type":"page","link":"https:\/\/equalpaynwt.ca\/fr\/les-plaintes\/processus-de-plainte\/","title":{"rendered":"Processus de plainte"},"content":{"rendered":"\n<p>Un employ\u00e9 peut d\u00e9poser une plainte par \u00e9crit aupr\u00e8s de la commissaire \u00e0 l&rsquo;\u00e9quit\u00e9 salariale.<br><br>La plainte doit \u00eatre d\u00e9pos\u00e9e au plus tard deux ans apr\u00e8s les derni\u00e8rs \u00e9v\u00e9nements ayant donn\u00e9 lieu \u00e0 la plainte.<br><br>Lorsque la commissaire \u00e0 l&rsquo;\u00e9quit\u00e9 salariale re\u00e7oit une plainte, elle doit en fournir une copie aux autres parties, \u00e0 savoir l&#8217;employeur et l&rsquo;agent n\u00e9gociateur, le cas \u00e9ch\u00e9ant.<br><br>La commissaire \u00e0 l&rsquo;\u00e9quit\u00e9 salariale doit enqu\u00eater sur la plainte et peut aider les parties \u00e0 la r\u00e9soudre. Lors de son enqu\u00eate, le commissaire est habilit\u00e9 \u00e0 :<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>demander \u00e0 toute personne d\u00e9tenant ou pouvant d\u00e9tenir des informations pertinentes de r\u00e9pondre aux demandes de renseignements orales ou \u00e9crites ;<\/li>\n\n\n\n<li>demander \u00e0 toute personne de produire des documents ou des choses que le commissaire \u00e0 l&rsquo;\u00e9quit\u00e9 salariale juge n\u00e9cessaires ;<\/li>\n\n\n\n<li>demander \u00e0 toute personne de compiler et de produire des informations relatives \u00e0 l&rsquo;\u00e9valuation des emplois et \u00e0 la r\u00e9mun\u00e9ration.<\/li>\n<\/ol>\n\n\n\n<p>La commissaire peut \u00e9galement engager des experts ou d&rsquo;autres personnes n\u00e9cessaires pour l&rsquo;aider \u00e0 mener l&rsquo;enqu\u00eate.<br><br>L&rsquo;enqu\u00eate doit \u00eatre termin\u00e9e par la commissaire \u00e0 l&rsquo;\u00e9quit\u00e9 salariale dans les six (6) mois suivant la r\u00e9ception de la plainte. Une fois l&rsquo;enqu\u00eate termin\u00e9e, la commissaire doit r\u00e9diger un rapport d&rsquo;enqu\u00eate comprenant des recommandations sur la mani\u00e8re de r\u00e9soudre la plainte, et l&rsquo;envoyer aux parties.<br><br>Les parties peuvent r\u00e9gler l&rsquo;affaire \u00e0 tout moment et doivent s&rsquo;efforcer de le faire apr\u00e8s avoir re\u00e7u le rapport de la commissaire.
